Puffco Gets Vaporizer Patent Suit Tossed Due to Licensing Snafu

Puff Corp. convinced a federal judge to dismiss an infringement suit over the atomizer in its $250 Peak vaporizer because the exclusive license SHO Products LLC inked with the patent’s first assignee was voided when the original owner subsequently assigned it to Puffco.

Plaintiff SHO “fails to establish ownership” of the patent, Judge George H. Wu wrote in an opinion issued Monday in the US District Court for the Central District of California. He dismissed the complaint for lack of standing and for failure to state a claim for patent infringement.
