The owner of the apparel brand Penguin told a federal court that NFT brand Pudgy Penguins Inc. is diluting its trademark by selling clothes using confusingly similar trademarks.
Pudgy Penguins sells clothes with names such as “Pudgy Penguins,” “Pengu Nation,” and “Forever Pudgy Penguins” that infringe and dilute PEI Licensing LLC’s rights in trademarks including “Penguin” and “Original Penguin,” PEI said in a complaint filed Wednesday in the US District Court for the Southern District of Florida. Pudgy Penguins began as a non-fungible token collection in 2021, according to its website.
