Public Access Channel Must Defend Bad-Faith Takedown Claims

A YouTube channel can press its claims that a Boston suburb’s public access channel knowingly sent false copyright takedown requests alleging infringement of city council meeting videos, a Massachusetts court ruled.

Channel 781 News, an unincorporated group of citizen journalists in Waltham, Mass. streaming on YouTube, plausibly alleged Waltham Community Access Corp. knew Channel 781’s use of government meeting clips were fair under federal copyright law, the US District Court for the District of Massachusetts said.
