US Commissioner of Trademarks David Gooder refused to revive an “Americold” trademark registration for refrigerator compressors Friday in the first petition decision designated as precedent in more than a decade.
TriGroup USA LLC did not respond by the deadline to a bid to cancel a 2023 registration under new cancellation procedures designed to target fraudulent marks, the precedential decision said. Gooder’s letter said only an “extraordinary situation” could waive the law’s requirement to respond timely, and TriGroup claiming an oversight and harm to its business due to a trademark dispute over the same mark in China didn’t suffice.
