PTO Director Reverses PTAB on Some Swaddle Suit Patent Claims

US Patent and Trademark Office Director Kathi Vidal dove into a dispute over baby-swaddling technology to resolve a question of statutory interpretation about patent claims that depend on one of multiple other claims from the same patent, reviving some nixed claims by an administrative tribunal in the process.

Vidal’s order modified a Patent Trial and Appeal Board ruling on Big Beings USA Ltd.'s US Patent No. 9,179,711 so that the multiple dependant claims survive insofar as they refer to a patent claim the tribunal upheld.
