PTAB Rules Against Patent Owners In Five More IPR Patent Challenges

The Patent Trial and Appeal Board issued five decisions in three disputes during the last few days of April that favored the challenger against issued patents. Out of 126 patent claims challenged in the five cases, only two were determined not shown to be unpatentable.

The board has now issued 60 “final written decisions” on the merits, with few decisions favoring the patent owner. However, the number of denials of petitions for inter partes review (IPR) or covered business method (CBM) review reached 110, with nine more since April 21.
