Prolitec Inc. lost a bid to dismiss ScentAir Technologies LLC’s counterclaim alleging its Aera smart-home fragrance system infringes a patent for the technology, as a federal judge rejected arguments for invalidating the patent.
Judge William C. Bryson found Prolitec’s contention that US Patent No. 10,838,388 covers a patent-ineligible abstract idea “unpersuasive,” according to an opinion issued Monday in the US District Court for the District of Delaware. Bloomberg Law estimates the patent will expire in July 2033.
