Pro-Gun T-Shirt Company Loses Right to ‘This We’ll Defend’ Mark

A California T-shirt company that sells pro-gun apparel had its trademark registration for “This We’ll Defend” canceled after a Illinois federal judge found that a different apparel company was the first to adopt the mark.

Grunt Style LLC, a Illinois company that also sells T-shirts and hangtags bearing the catchphrase, first started using the mark in 2011, three years before TWD LLC.

Therefore, Grunt Style has superior common law rights to the mark, Judge Charles P. Kocoras of the U.S. District Court for the Northern District of Illinois said.
