Prime Medical Loses Eligibility Challenge to Surgical Kit Patents

Prime Medical LLC couldn’t convince a Tennessee federal judge that patents on a surgical positioning kit simply apply natural laws and aren’t eligible for protection.

Xodus Medical Inc.’s patents cover a system that secures a patient to an operating table when the patient’s feet are elevated during surgery. Prime argued the patents seek to invoke laws of friction and laws “inherent in foam” to prevent patient movement.
