The Third Circuit agreed to review Ross Intelligence Inc.'s appeal of a district court ruling finding its AI-powered legal tool’s ingestion of Thomson Reuters’ Westlaw headnotes isn’t fair use under copyright law.

The first summary judgment ruling rejecting a fair use defense in an AI-training copyright suit is ripe for immediate appeal, according to an order issued Tuesday by the US Court of Appeals for the Third Circuit. The order was signed by Judge Cindy K. Chung, and joined by Judges Peter J. Phipps and D. Brooks Smith.
