PPG Keeps $26 Million Trade Secrets Award Against Window Maker

A $26 million trade secrets judgment against a China-based window manufacturer was upheld Tuesday by the Third Circuit, which found that development costs can be the basis for measuring unjust enrichment.

Jiangsu Tie Mao Glass Co. Ltd. originally failed to appear in court after being sued for stealing trade secrets that PPG Industries Inc. used to develop “Opticor,” a new kind of plastic used for airplane windows.

A judge for the Western Distirct of Pennsylvania entered a default judgment against Jiangsu Tie, and tripled PPG’s request for $8.8 million in damages.
