PNC Nixes USAA Phone Patent Underlying $4.3 Million Verdict (1)

The Federal Circuit wiped out a USAA patent on Thursday that underpinned an East Texas federal jury’s $4.3 million infringement verdict against PNC Bank NA over technology that allows smartphones to scan checks.

The appeals court’s ruling affirmed the portion of a May 2023 Patent Trial and Appeal Board decision that invalidated as obvious 14 of 20 claims from US Patent No. 10,769,598—one of several mobile check-scanning patents owned by the United Services Automobile Association. The three-judge panel also reversed the administrative tribunal’s conclusion that six claims survived PNC’s obviousness challenge.
