Magazine publisher Maxim Inc. failed to secure a ban on rival Playboy Inc. using its proprietary information related to its modeling contest during its copyright and trade secrets suit.

The lifestyle brand failed to show a likelihood of prevailing on any of its claims, and its delay in seeking the injunction undercut its claims of irreparable harm, the US District Court for the Southern District of New York said.
