The Federal Circuit upheld a lower court’s $776,000 damages award to a pitching machine-maker that accused a California rival of patent infringement.
ProBatter Sports LLC of Milford, Conn., sued Burbank-based Sports Tutor, Inc., in 2005 for allegedly seeing ProBatter’s machine at a trade show and copying it, according to a legal brief filed by ProBatter with the US Court of Appeals for the Federal Circuit.
In 2022, 17 years after the start of the legal battle a federal judge in Connecticut awarded the company $388,000 in damages, which it doubled to $776,000 along with prejudgment interest dating back to 2003. ...
