The creator of a baseball pitching training program successfully defended the bulk of an overall victory in a trademark lawsuit brought against a former licensee.
Dr. Thomas House and his National Pitching Association Inc. convinced the US Court of Appeals for the Sixth Circuit to affirm a $340,000 trademark award against Player’s Dugout Inc., but not a $68,000 punitive damages award. NPA also won $40,000 for breach of contract at the same trial. Player’s Dugout, however, won $200,000 from NPA on defamation and other assorted claims.
