The Federal Circuit agreed with an administrative board that an e-pipe patent asserted against Philip Morris Products SA is anticipated by an earlier invention and thus invalid.

The company was sued along with Philip Morris USA in federal court in Atlanta by Healthier Choices Management Corp. in 2020 over alleged infringement of US Patent No. 10,561,170. Philip Morris Products SA asked the PTAB to weigh in on its validity after being sued.
