PetSmart’s New Cat Litter Packages Stink, Purina Says (1)

PetSmart Inc. copied the design of Nestlé Purina PetCare Co.'s Tidy Cats packaging when it updated the look of its generic cat litter, Purina says in a Dec. 21 complaint.

The pet supplier used different packaging for years before adopting the Tidy Cats style and color schemes, Purina says, alleging trade dress infringement.

PetSmart’s new packing incorporates “all” of the visual properties of Tidy Cats, making consumer confusion “inevitable.”
