PetIQ asked the Patent Trial and Appeal Board to review Bayer’s US Patent No. 7,910,122 in December, arguing the patent covers an obvious invention, ineligible for protection. The PTAB denied the petition for inter partes review in a Thursday decision.
“We are not persuaded that Petitioner has provided sufficient argument and supporting evidence to demonstrate a reasonable likelihood that challenged claims” are obvious, the PTAB wrote.
