PepsiCo’s Gatorlyte Launch Blocked Again Over Trademark Problems

A federal judge in Texas issued another emergency injunction preventing PepsiCo Inc. from selling or advertising its new Gatorlyte product, finding that Laboratorios Pisa SA, a Mexican company that makes Electrolit rehydration drinks, is likely to succeed in proving PepsiCo copied its packaging.

Gatorlyte likely infringes Electrolit’s rectangle-shaped bottle design and its labeling, which includes a diagonal white banner, circular “Premium Hydration” and “Scientific Formula” badges, and “prominent” product name placement, Judge Micaela Alvarez of the U.S. District Court for the Western District of Texas said.
