PepsiCo Beats Trade Secret Claims Over Flavor-Enhancing Bottles

PepsiCo Inc. defeated claims that it stole trade secrets to win a patent on flavor-enhancing drink bottle technology.

ScentSational Technologies LLC failed to prove causation or damages based on an alleged lost contract with Coca-Cola Co., the U.S. Court of Appeals for the Federal Circuit said in an unpublished ruling May 16.

ScentSational owns trade secrets related to “adding aromas to beverage bottles in order to enhance the perceived taste of the beverage.” After failed negotiations, Pepsi allegedly violated a non-disclosure agreement and used the trade secrets to win a patent on the technology.
