Patent Suit Stemming From Amazon Complaint Revived by Fed. Cir.

The Federal Circuit revived a Utah lighting company’s lawsuit seeking to clear itself of patent infringement allegations made by a patent owner seeking removal of its products from Amazon.com Inc.

The appeal turned on whether a complaint filed through Amazon’s Patent Evaluation Express program, APEX, establishes personal jurisdiction such that a targeted Amazon seller can sue the complainant in their home-state court.
