Patent Owners Set New Record for Attempts to Amend Claims

Patent owners attempted to amend patent claims with a U.S. Patent and Trademark Office administrative tribunal a record number of times in 2018, an agency study found.

Motions to amend filed with the Patent Trial and Appeal Board jumped from 50 in fiscal year 2017 to 114 in fiscal year 2018, ending Sept. 30, the agency said in its study. Patent owners sought to amend claims in 326 of 3,599 trials that have made it to settlement or completion, the agency said.
