Patent Office to Issue Guidance on AI Misconduct, Vidal Says (1)

The US Patent and Trademark Office will clarify its rules governing the use of artificial intelligence tools for practitioners at its administrative tribunals, including possibly related misconduct, in the Federal Register in the coming months.

The agency’s forthcoming guidance will elaborate on existing rules, including its Rules for Professional Conduct, “and their applicability to the use of AI tools by parties and practitioners,” Director Kathi Vidal told the Patent Trial and Appeal Board, Trademark Trial and Appeal Board, and Office of the General Counsel in a memorandum dated Tuesday.
