Patent Office Gives Further Guidance on Arthrex Director Review

The U.S. Patent and Trademark Office has updated its guidance on how it will carry out the U.S. Supreme Court decision empowering its director to review Patent Trial and Appeal Board decisions.

A week after the high court’s United States v. Arthrex decision, the agency announced an interim process under which its director may review a PTABdecision on patent validity on its own or at the request of the parties. The July 20 update clarifies the scope of review requests and how the agency will handle them .
