The US Patent and Trademark Office is finalizing a rule to eliminate senior leadership’s involvement in administrative tribunal decisions before they’re issued.
The final rule, which is set to be published Wednesday in the Federal Register, generally codifies interim procedures that have been in place since May 2022 governing circulation and review of decisions by administrative patent judges at the Patent Trial and Appeal Board. The PTAB reviews challenges to patents’ validity and appeals of patent examiners’ decisions.
