Patagonia Wins Dismissal of Texas Copycat’s Trademark End Run

Patagonia Inc. convinced a federal judge to throw out a lawsuit by a Texas apparel maker it argued was trying to circumvent a California court order blocking the upstart from selling clothing with confusingly similar logos.

The apparel giant argued Irregular IP LLC’s 2023 suit seeking declaratory judgment it was not infringing Patagonia’s trademarks was an attempt to “re-litigate” copyright and trademark claims Patagonia won “against the exact same designs” in California the year before, according to a dismissal order in US District Court for the Western District of Texas.
