P&G Sued for Allegedly Infringing ‘Smart Monitor’ Trademark

Procter & Gamble Co. was sued in Pennsylvania federal court on Tuesday by a company that makes SmartMonitor infant apnea monitors, alleging that P&G’s Pampers-brand Smart Baby Monitors infringe its trademark.

Circadiance LLC’s SmartMonitor device monitors heart and respiration activity, primarily in infants. It owns a federal trademark registration for “Smart Monitor” covering cardio-respiratory patient monitors.

P&G sells the Smart Baby Monitor in connection with its Lumi by Pampers monitoring system. According to the complaint, P&G’s sale of baby-monitoring devices using a name similar to SmartMonitor is likely to cause confusion and mislead customers into thinking Circadiance is associated with ...
