Overstock Defeats Lexos’ Website Cursor Patent Infringement Suit

Overstock.com stopped Lexos Media IP LLC’s suit alleging infringement of three patents that relate to modifying the display of a cursor image on a website, a Kansas federal district court said.

Overstock defeated the suit because Lexos already had a full and fair chance to litigate the issue of one patent’s validity, and therefore the doctrine of collateral estoppel applied to bar that claim, Judge Julie A. Robinson of the US District Court for the District of Kansas said Monday.

Robinson also found Lexos’ expert offered inadmissible testimony, leaving no evidence of infringement, and that Lexos’ infringement theory was inconsistent ...
