Otsuka’s Taiho Expands Feud Over Cancer Drug With Aurobindo (1)

Otsuka Holdings Co.’s Taiho unit expanded its courtroom fight with Aurobindo Pharma Ltd. and its Eugia unit, alleging the proposed copy of Lonsurf infringes two patents for the drug, used to treat metastatic colorectal cancer.

Each of the patents covers a method for treating cancer patients with severe impairment of the kidneys, according to a complaint filed Tuesday in the US District Court for the District of Delaware.

Taiho says that discovery “will likely show” that the proposed labeling for Eugia’s generic version of Lonsurf “is substantially the same as the approved product labeling for Lonsurf.” It alleges the labeling ...
