OpenSky, VLSI Face Off Over Sanctions, Damages at Patent Office

VLSI Technology LLC told the US Patent and Trademark Office that OpenSky Industries LLC should face further sanctions and attorneys fees for abusing the patent challenge process, while OpenSky countered that the sanctions weren’t warranted and further penalties would be unconstitutional.

Following an Oct. 4 order by PTO Director Kathi Vidal removing OpenSky from its inter partes review of a VLSI patent, VLSI submitted a response encouraging further sanctions.
