OpenAI Must Face ‘Open AI’ Trademark Owner’s Infringement Claims

A federal judge denied OpenAI Inc.'s motion to toss claims that the AI giant infringed the “Open AI” trademark owned by a similarly named company, Open Artificial Intelligence Inc.

Open Artificial Intelligence sufficiently argued OpenAI’s branding creates consumer confusion, said Judge Yvonne Gonzalez Rogers in an order citing emails from users who believe it’s associated with OpenAI, and an increase in web traffic after the announcement of OpenAI’s ChatGPT.
