A New York federal judge rejected
The download allegations don’t violate a May order barring new claims because, although the authors’ theory of liability changed, the underlying infringement claims and facts were already present in earlier pleadings, Judge Sidney H. Stein said in an opinion docketed Tuesday in the US District Court for the Southern District of New York.
