An online sports network’s “O” trademark doesn’t infringe Ohio State University’s trademarks in the same letter, Overtime Sports said in a Dec. 23 complaint filed in Brooklyn federal court.
Overtime is requesting a judgment of noninfringement in response to the university’s threat to sue, it said.
Overtime is an “online and social media-based sports network” that focuses on “young, digital-native sports fans.” Its “O” mark is “distinctive due in large part to its sloping corners within each of its concentric shapes, which contrast with the sharp-cornered rectangle at its center,” the complaint alleged.
