Ohio State, Redbubble Settle, Leaving Trademark Liability Murky

Ohio State University dropped its trademark claims against Redbubble Inc., leaving questions unanswered about the print-on-demand marketplace’s liability for user infringement.

Terms of an apparent settlement weren’t clear in Friday’s filing noting the agreement in the US District Court for the Southern District of Ohio.

Attorneys for both Ohio State and Redbubble didn’t return requests for comment.

The district court had awarded Redbubble summary judgment before the US Court of Appeals for the Sixth Circuit revived the case, demanding closer inspection of Redbubble’s involvement and control over the manufacturing of user-designed goods.
