Ocado’s Robotic Warehouse Patent Survives Early Dismissal Bid

AutoStore AS couldn’t convince a New Hampshire federal judge to toss part of a patent suit related to an automated grocery delivery system, striking out in its attempt to deliver what would’ve been a significant blow to Ocado Innovation Ltd.’s infringement case.

Judge Joseph Laplante in the U.S. District Court for the District of New Hampshire said he wasn’t convinced Ocado’s U.S. Patent No. 10,901,404 covers an abstract idea and is invalid. He denied AutoStore’s motion to dismiss the patent from the suit.
