Jarrow Formulas Inc. lost its challenge to a $2.4 million verdict for misappropriating Caudill Seed and Warehouse Company Inc.'s trade secrets related to a system for creating broccoli seed extract, because the Western District of Kentucky held that sufficient evidence supports the award.
Caudill, which was in the process of creating a market-ready activated broccoli extract product for supplements, sued Jarrow under the Kentucky Uniform Trade Secrets Act after its former employee, Kean Ashurst, resigned to help Jarrow start up its own extract process.
