The owner of Dungeons & Dragons failed to convince a Seattle federal court to ban a racist role playing game allegedly using its trademarks—because of a promise not to release it during litigation.
Counsel for TSR LLC committed during oral argument to refrain from publishing Star Frontiers New Genesis during trademark litigation over “Star Frontier” and “TSR,” the US District Court for the Western District of Washington said. TSR sued Wizards of the Coast LLC for declaratory judgment that the marks had been abandoned, and Wizards responded with infringement, cybersquatting, and other counterclaims.
