No Attorneys’ Fees in ArcelorMittal Steel Patent Case

ArcelorMittal‘s conduct in a long-running patent case was troubling, but didn’t justify attorneys’ fees, the U.S. District Court for the District of Delaware ruled Feb. 7.

Arcelor owned U.S. Patent No. 6,296,805, related to high-strength steel sheets, and sued AK Steel Corp. for infringement in the U.S. District Court for the District of Delaware in 2010. A jury ruled that AK Steel didn’t infringe and that the patents were invalid.

After the Federal Circuit partially reversed and remanded, Arcelor filed for reissue of the ‘805 patent with additional claims. That issued as U.S. Patent No. RE44,153. After another decision, ...
