New Jersey Transit Corp. told a New York federal court it’s constitutionally immune from patent-infringement claims and Railware Inc.'s lawsuit over railworker-safety technology should be thrown out.
“NJ Transit is an arm of the State of New Jersey and is entitled to sovereign immunity under the Eleventh Amendment of the United States Constitution,” the agency said in a brief supporting its dismissal motion filed Sept. 6 in the US District Court for the Southern District of New York. The immunity, it said, bars Railware’s patent-infringement claims “and all relief sought in this action.”
