The Eighth Circuit revived LADS Network Solutions Inc.'s lawsuit accusing Agilis Systems LLC of infringing its copyrighted software, reversing a lower court’s ruling that the copyright registration is invalid.
Factual questions remain about whether LADS was aware that the code it submitted to the US Copyright Office was created after the effective date of the registration, making summary judgment inappropriate, according to an opinion issued Wednesday by the US Court of Appeals for the Eighth Circuit. The three-judge panel vacated the district court’s grant of summary judgment in favor of Agilis and remanded the case for further proceedings.
