Nirvana Merchandise IP Case Suited for UK Courts, 9th Cir. Says

A copyright dispute over whether the rock band Nirvana used an artistic rendering of “Upper Hell” from poet Dante Alighieri’s “The Divine Comedy” on merchandise without permission is better suited for courts in the United Kingdom, the Ninth Circuit ruled.

A three-judge panel for the appeals court upheld a district court ruling dismissing the copyright lawsuit brought by UK citizen Jocelyn Bundy, whose grandfather drew “Upper Hell” in 1949 for an English translation of the Italian epic poem.
