The Federal Circuit sided with a district court’s ruling that Nintendo Co.'s Switch console doesn’t infringe claims from several Gamevice Inc. video game controller patents.
The appeals court’s determination focused on the use of screws to affix components on the Switch, as opposed to “apertures” required by claims from Gamevice’s US Patent Nos. 9,808,713 and 10,391,393.
“Here, neither the Switch buttons nor joysticks are secured by the apertures,” wrote Judge Raymond T. Chen in an opinion issued by the US Court of Appeals for the Federal Circuit on Friday.
