The Federal Circuit reversed a dismissal of NimbeLink Corp.'s patent suit against Internet-of-Things company Digi International Inc. over cellular modem technology.
NimbeLink had argued a district judge in Minnesota misread a term in the identical preamble sections of its US Patent Nos. 9,497,570 and 9,838,066—for a “space-efficient cellular modem device“—in a manner that rendered the patents invalid. The US Court of Appeals for the Federal Circuit reversed the invalidity ruling, but for a slightly different reason: the language shouldn’t have been treated as a limitation that defines the scope of the patents in the first place.
