Nichia Corp. lost an administrative tribunal challenge to the validity of a patent on LED technology that it has been accused of infringing.
Nichia asked the Patent Trial and Appeal Board to review Document Security Systems Inc.’s U.S. Patent No. 6,879,040 after that company sued it in 2019 for alleged infringement. Nichia argued various patent claims are invalid because they were anticipated or made obvious by earlier inventions.
The PTAB upheld the validity of all the challenged claims in a decision Tuesday, finding Nichia “has not met its burden to show that” the claims “are unpatentable.”
