Newsweek LLC and fine art photographer Elliot McGucken settled a copyright dispute that raised the question whether the display of an embedded Instagram post could qualify as infringement.
An attorney for Newsweek told Bloomberg Law that the terms of the settlement are confidential.
Judge Katherine Polk Failla of the U.S. District Court for the Southern District of New York previously denied early wins to both parties.
She declined to determine in March whether embedding McGucken’s Instagram post containing a copyrighted photo of a lake in Death Valley, Calif., in a Newsweek article fell under fair use.
