New York can continue issuing adult-use cannabis licenses despite allegations that the state’s cannabis program unconstitutionally favors New York residents.

A prohibition on New York’s dispensary licensing program would harm the state’s adult-use cannabis industry, including the nearly 7,000 adult-use applicants and the nearly 400 dispensary applicants with provisionally approved licenses under the Conditional Adult-Use Retail Dispensary License who “have invested substantial capital into their businesses,” Northern District of New York Judge Anne Nardacci said in her decision Friday.
