Three eye surgery device patents owned or licensed by MicroSurgical Technology Inc. are invalid, an administrative tribunal decided in challenges brought by rival New World Medical Inc.
New World asked the Patent Trial and Appeal Board to review the patents after it was sued for alleged infringement. The board found each of the patents cover inventions that either aren’t novel or are obvious.
“After considering the parties’ arguments and supporting evidence, we conclude that Petitioner proves by a preponderance of the evidence” the patents are invalid, the PTAB wrote in the decisions.
