The Patent and Trademark Office has set a new precedent for amending patent claims during administrative law disputes.
The agency designated a Patent Trial and Appeal Board decision in a challenge by Lectrosonics, Inc., a wireless audio device company, to patents held by Zaxcom, Inc. as precedential March 7.
The February decision is guidance on statutory and regulatory requirements for filing motions to amend patent claims, following two 2017 orders out of the Federal Circuit Court of Appeals. The PTAB narrowed the scope in which parties can amend or challenge amendments to claims.
