New England Biolabs Beats Injunction Bid on Genetic Cancer Tests

New England Biolabs Inc.’s epigenetic cancer test kits won’t be blocked during a patent-infringement suit by a British bioscience company and an affiliated US children’s medical charity, a federal judge ruled.

Judge Richard G. Stearns expressed doubt about whether Biomodal Ltd. and the Children’s Medical Center Corp. had shown they’d be irreparably harmed absent a preliminary injunction, according to an opinion issued Monday in the US District Court for the District of Massachusetts. Stearns cited “the availability of monetary damages and the cautionary recent Supreme Court decision reminding district courts of the extraordinary and rare grant of this equitable remedy.” ...
