New Cuba Trademark Law Sinks Heineken’s Rights, Brewer Argues

A Heineken NV unit can’t prevent its “La Tropical” beer trademarks from being challenged by artificially limiting who can invoke a ban on enforcing stolen trademarks, a California brewer argued.

Soltura LLC told the US District Court for the Southern District of Florida that nothing in the No Stolen Trademarks Honored in America Act barred it from seeking cancellation of Cerveceria La Tropical’s trademarks. La Tropical’s motion to dismiss Soltura’s counterclaim would frustrate the law’s intent by restricting its use only to original owners or direct successors .
